Terms of Service

1. Acceptance of Terms

By accessing the website shifra.to (the “Site”) and using the services offered by Shifra (the “Service”), you acknowledge that you have read, understood and accepted these Terms of Service (“Terms”) without reservation. If you do not accept these Terms, you must immediately stop using the Service.

2. Description of the Service

Shifra is an aggregator of digital-asset exchange rates. The Service allows the User to compare and execute exchange operations (“swaps”) between different crypto-assets through third-party liquidity partners. Shifra does not hold User funds: assets transit only between the addresses provided by the User and the liquidity partners.

3. Eligibility

The User represents that they are at least 18 years old and have the legal capacity to enter into a contract. The User declares that they do not reside in, are not a citizen of, and do not act from any country subject to international sanctions (including OFAC, European Union, UN), nor from any territory where the use of crypto exchange services is illegal or restricted.

4. User Account

Most features are accessible without an account. If the User creates an account (notably for the affiliate program), they undertake to provide accurate information, protect their credentials and enable two-factor authentication (2FA) when offered. The User is solely responsible for any activity carried out from their account.

5. Risks Related to Crypto-Assets

The User expressly acknowledges that crypto-assets are volatile and that their use entails significant risks, including:

  • Extreme price volatility and risk of total loss of capital.
  • The irreversible nature of blockchain transactions: any error in address, network, memo/tag or amount may result in permanent loss.
  • Risks related to protocols, smart contracts and liquidity partners.
  • Regulatory, tax and currency risk.

6. Prohibited Use

The User undertakes not to use the Service for unlawful purposes, including:

  • Money laundering or terrorist financing.
  • Fraud, scams, identity theft, phishing.
  • Circumvention of international sanctions.
  • Attacks on information systems (abusive scraping, DDoS, injections, etc.).
  • Any activity contrary to public order or accepted standards of morality.

7. Fees, Rates and Execution

Displayed rates are indicative and may vary until the operation is confirmed. Any fees (network fees, aggregator margin, partner fees) are shown before validation. Shifra does not guarantee a precise execution time, nor a fixed rate beyond the validation window displayed.

8. Affiliate Program

The affiliate program allows a registered User to earn a commission on operations carried out by Users referred via their unique link. Commission rates, thresholds and payout terms are detailed in the affiliate dashboard. Shifra reserves the right to suspend or terminate an affiliate's participation in case of fraud, spam, artificial referral activity or any other abusive practice.

9. Intellectual Property

All elements of the Site (brand, logo, code, design, editorial content, images) are protected by intellectual property law and remain the exclusive property of Shifra or its licensors. Any unauthorized reproduction, representation or exploitation is prohibited.

10. Limitation of Liability

The Service is provided “as is” and “as available”. To the maximum extent permitted by applicable law, Shifra shall not be liable for:

  • any direct or indirect loss (loss of funds, profit, opportunity) arising from the use of or inability to use the Service;
  • errors made by the User (address, network, memo, amount) or by third parties (liquidity partners, blockchains, exchanges);
  • interruptions, bugs, delays or failures caused by force majeure or events beyond Shifra's control.

11. Indemnification

The User agrees to indemnify Shifra against any claim, loss, liability or expense (including reasonable legal fees) arising from the use of the Service in breach of these Terms or applicable law.

12. Modifications

Shifra may modify these Terms at any time. The “Last updated” date is shown at the top of this document. Continued use of the Service after publication of a new version constitutes acceptance.

13. Governing Law and Jurisdiction

These Terms are governed by the law applicable at Shifra's place of establishment. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the courts in the same jurisdiction, subject to mandatory consumer-protection provisions.
